財團法人（foundation）為一具有法人資格的「財產的集合體」，由捐助人捐助一定數額的財產，並經一定法定程序而成立之法人團體。其相對概念為社團法人



 中華民國之規定


財團法人之成立，必須以公益為目的。其設立採取許可主義，即成立前須經主管機關之許可。[1]。在名稱上必須明示其為某某財團法人，以及其性質，如輔仁大學學校財團法人[2]輔仁大學；若所捐助之財產純粹為金錢，則可冠以「某某基金會」之名稱，如洪建全教育文化基金會[3]
